Altice to be sold

Altice to be sold

Tofane Global has agreed to acquire Altice’s wholesale voice carrier business in France, Portugal and the Dominican Republic. Tofane Global is described online as a new French player in the telecom and digital sectors, and a specialist of international inter operators’ carrier services”. The company is led by Alexandre Pébereau, previously with Orange, Maroc Telecom and Bollore.

A statement has been released saying Tofane, has entered into exclusivity to buy its international voice carrier assets, grouped as Altice International Wholesale (AIW).

The three entities of AIW (SFR Carriers, Meo and Orange Dominicana) transported 14 billion minutes of international voice traffic in 2017. The deal, should it be completed, will see Tofane continue to remain as a strategic partner for Altice, it said.

According to Pebereau, “Once all authorizations are received Tofane Global will become the third largest provider of voice and mobile data services in the world.”

Altice said in its statement: “Altice N.V. announces today it has entered into exclusivity with Tofane Global, a Paris-based telecommunications and digital player specializing in international carrier services, for the sale of its international wholesale voice carrier business in France, Portugal and the Dominican Republic.

“This transaction shows further execution of Altice’s non-core asset disposal program to strengthen the company’s long-term balance sheet position and focus on improving the operational and financial results of its key franchises.”

Altice had completed its agreement for the merger of the previously purchased Orange and Tricom telecom operations in the Dominican Republic with Indotel, the Dominican telecom regulators, in September 2017.

Tensions on the rise between Haitians and Dominicans in Pedernales

Minister of Interior and Police Carlos Amarante said a contingent of National Police and army agents were sent to Pedernales to reinforce security in that city in response to a video circulating on social media motivating the population to forcibly expel Haitians living in the area in revenge for murders of a three Dominicans in which Haitians are being accused of having committed the crimes. He said the border security agency Cesfront and the Army are working to suppress the upsurge in violence the province.

According to the Mayor of Pedernales, Luis Manual Feliz, a “disco light” vehicle carrying unknown persons travelled throughout all of Pedernales announcing on loud speakers that Haitians had 24 hours to leave or face violent actions against them.

The Mayor has asked that President Medina and Foreign Minister Vargas as yesterday to intervene in the crisis. Amarante reported that on Monday, 12 March 2018, two Haitians who were attacked and injured and are being treated at a local hospital.

At the same time, dozens of people protested in front of the Public Prosecution office, the police station and military stations demanding justice for the murders of farmer Julio Reyes Pérez and his wife Neiba Féliz Urbáez who were attacked with machetes. Haitians are the lead suspects. Julio Reyes is a close relative of former senator for Pedernales, Angel Dignocrates Pérez.

The couple was attacked on 20 February 2018. Reyes Perez died at the scene of the attack. On Sunday, 10 March, his wife, Neiba died from her injuries while being treated in the intensive care unit in the Ney Arias Lora hospital in Santo Domingo.

Another murder attributed to Haitians is that of 26-year old Turbí Díaz whose body was found in the Oviedo garbage dump.

The demonstrators carried placards asking for justice saying that the crimes were carried out by Haitians who then fled across the border.

Yesterday, Monday 12 March, Haitians were seen leaving the city to avoid acts of revenge by Dominicans.

Interior and Police Minister Amarante said local authorities are in touch with Haitian authorities for the arrest in Haiti of the lead suspects in the crimes.

Visas no longer needed to travel to Nicaragua

Dominicans can travel to Nicaragua without a visa. Likewise, citizens of Nicaragua can visit the Dominican Republic for the same period of up to 90 days.

Italian convicted to 15 years in jail for child pornography

A Puerto Plata court issued a 15-year jail sentence to Giuseppe Sgarbi, an Italian citizen for operating a child pornography network from the Dominican Republic. Sgarbi will serve his sentence at the San Felipe prison. The network had been operating in the Caribbean since the 80s.

The case against Sgarbi was based on evidence in the case of two teenagers, ages 16 and 17 years old. When arrested in his residence, digital evidence of pornographic images of children ages 11 to 16 years was collected. Also investigators interviewed multiple other victims who said they were encouraged to visit Sgarbi at his home where he prepared the pornographic material. He was sentenced for violating Arts 1, 3 and 7 of the Illicit Trafficking in Persons Law 137-03 and Arts 396, 410 and 411 of the Child Protection Code Law 136-03 and Art. 24 of the High Tech Crimes Law 53-07.

Judge Osvaldo Bonilla said the ruling seeks to send a message to other foreigners who use the country for these atrocities against vulnerable children.

Re-election in the air

The sister of President Danilo Medina, former president of the Chamber of Deputies, Lucia Medina said on Saturday, 11 March 2018, that in her understanding the 2015 Constitution does not ban the President from seeking another term. She said to seek reelection or not is a personal decision to be made by the President.

Constitutional scholars would note that this is her interpretation of the 2015 Constitution that amended the 2010 Constitution. The 2015 Constitution allowed President Medina to seek reelection in 2016.

Lucia Medina says the 2015 Constitution includes language that authorizes the president to run for two consecutive terms and then never again. She noted that under the current Constitution, Danilo Medina has only been in office one election cycle. She feels the 2012-2016 cycle does not count.

She insisted that only President Medina would make the decision to seek reelection and that his political part, Dominican Liberation Party (PLD), would abide by his decision. Lucia Medina noted that, of course, the final vote of approval would be granted by the Dominican people in the 2020 election itself.

The legislator made the statement after the official spokesman for the Presidency, Roberto Rodríguez Marchena, said on a television program that a part of the population is in favor of the reelection of Medina. This was earlier responded to via Twitter by Franklin Almeyda, former Minister of Interior, and member of the PLD political committee, who said that Rodríguez Marchena should limit himself to his role as spokesman for the Executive Branch. Almeyda is said to be close to former President Leonel Fernández who has the highest ratings in the PLD of those authorized by the 2015 Constitution to take part in the 2020 election.

Chapter II of the 13 June 2015 Constitution includes temporary clauses that establish: “In the case of the President of the Republic, corresponding to the constitutional period 2012-2016, if candidate to the same position for the constitutional period 2016-2020, not being able to run for the next period or any other period, and neither for the position of Vice President of the Republic.”

Meanwhile, Listin Diario reported that lawyers and politicians are seeking a legal pathway that would re-interpret the clause that prohibits a president to be reelected. The alternative interpretation of key clauses in the Constitution could provide a framework for a legal argument to be made to the Constitutional Court that would essentially permit Medina to run for reelection. This appeal to the Constitutional Court was made by attorney Fredermido Ferreras Díaz on 15 February 2018, and has been assigned the case number TC-01-2018-003.

El Caribe newspaper recalls that on 17 June 2015, President Danilo Medina, in an address from the Presidential Palace on the constitutional amendment Art. 124 that allowed him to run for office in 2016, explained this would mark the end of his political career. “Also, by backing this reelection amendment, I was also taking the decision to end my political career, because it is understood that after these four more years, if the people vote for me in May 2016, I will not be able to be a candidate for President of the Republic again.”

The possibility of President Medina seeking reelection has divided the party, primarily between followers of Medina and those of former President Leonel Fernández who had sought to run again for President in 2016.

Dominican Republic boosts security along Haiti border

SANTO DOMINGO, Dominican Republic (CMC) — Security officials in the Dominican Republic, say they have beefed up security along the border with Haiti in order to stem the flow of illegal immigrants

According to Defence Minister Rubén Paulino, additional troops from the three military branches, as well as intelligence units have been deployed.

He says the plan includes 50 drones, 50 vehicles, 200 motorcycles, and air force aircraft and navy boats to patrol the coastline.

In making the recent announcement, Paulino warned those in the agricultural sector in particular, against hiring Haitian labourers illegally and encourged them to hire Dominican nationals.

The defence minister also visited the towns of Dajabón, Elías Piña and Jimaní – all located along the border, to supervise the start of operations that will be headed by Army commanders and for which that institution has deployed the 900 soldiers.

He added that the operations, “complies with the provisions of President Danilo Medina in his speech last month to counteract the traffic of undocumented immigrants, drug trafficking, smuggling in the zones and establish health and sanitary controls.”

The Dominican Republic and Haiti share the island of Hispaniola.

The dramatic story “Memory for my departure from the island of Santo Domingo on April 28, 1805? (“Memoria de mi salida de la isla de Santo Domingo el 28 de abril de 1805?), the Dominican Jurisconsultist Gaspar de Arredondo y Pichardo, reveals that forty (40) children were beheaded in the Church of Moca, and that the bodies were found in the presbytery, which is the space that surrounds the main altar of some churches. This tragedy, unparalleled in the history of the island, was part of a genocide that killed thousands of Dominicans.

The dramatic story “Memory for my departure from the island of Santo Domingo on April 28, 1805? (“Memoria de mi salida de la isla de Santo Domingo el 28 de abril de 1805?), the Dominican Jurisconsultist Gaspar de Arredondo y Pichardo, reveals that forty (40) children were beheaded in the Church of Moca, and that the bodies were found in the presbytery, which is the space that surrounds the main altar of some churches. This tragedy, unparalleled in the history of the island, was part of a genocide that killed thousands of Dominicans, many of them slaughtered. This catastrophe, also without precedent in the islands history, was carried out by the troops of the Haitian general named Henri Christophe, who was led by Jean Jacques Dessalines, when they were retreating from the Spanish part of the island during their attempted invasion of that year in 1805.

Interestingly enough in this commentary and the particular highlights of the tragedy involving Dominican children brutally beheaded and abducted as prisoners and then were made to walk on foot towards Haiti is inexcusable. The slaughter of 40 children in Moca is documented in the story of Gaspar de Arredondo and Pichardo. In his work that is also introduced in the same issue, Alejandro includes this gloomy paragraph:

April 6, Henri Christophe gathers all his troops in Santiago; he kills in the cemetery the prisoners which were all males, among them was a priest by the name of Vasquez and 20 other clerics, they then sets fire to the village and its 5 churches, and left leading a flock of 249 women, 430 girl and 318 boys.

Note that the kid’s throats which were slit in the main altar of the Church of Moca were only 40.

Interestingly enough the relationship of women-children that were brought from Santiago to Haiti “as a herd”, were only 249 women, the children totaled 748, it is to say, three times more boys and girls than women. Women and children of Santiago treated as prisoners and dragged towards Haiti totaling 997 people.

There is very credible information of the actions which points out and identifies it in Moca and Santiago, but ‘Llenas’ narrates that, by the order of Henri Christophe, “Monte Plata, San Pedro and the Cotuí were reduced to ashes, and its settlers beheaded or led away as captive”.

By that order 900 ‘Veganos’ (La Vega province) were also dragged. Santiago was burnt to ashes (now second capital), in addition also San Francisco de Macorís, Moca, Puerto Plata and Montecristi provinces. It is clear that when it is said that they were “dragged”, 900 Veganos to Santiago that indicates the amount of people which were taken as prisoners and everyone had to walk. In a way, 900 Veganos were taken, “dragged”, it must be added which were being “dragged” from Moca, Monte Plata, Cotuí, San Francisco and San Pedro, and those who were taken prisoners in Puerto Plata and Montecristi, were equally “dragged” made to walk towards Haiti.

All this is a tragedy large enough for which, in relation to the present work, two considerations need to be referred to, the first designated already by said authors, and the second one of which would explain the emphasis, in particular interest , of the beheading and the treatment of children like prisoners, “dragged” and made to walk towards Haiti.

The first

The first consideration to which I refer is the circumstance in which Dessalines has to leave the place. Santo Domingo in 1805 was a failure of enormous dimension for Haiti, equivalent to a severe military defeat because the capital of the former Spanish colony was Santo Domingo. This was a strategic important move, because it was occupied by the French army. This was their number one military goal for Haiti to take the main Capital.

This adverse situation antagonized notably Dessalines, who before leaving he cited; “I did give the order to the commanders of several communes which were conquered to meet everyone and reduce them to prisoners, so your first order is to make them stomp like mules and other animals, when they reach the Haitian part”.

In addition, in virtue of his latest instructions Dessalines left several generals before leaving the place, “they pushed in front of them the rest of the inhabitants, animals and beasts… reduced to ashes all of the towns, villages, herds and cities, they carried everywhere the devastation, iron and fire, and only forgave the individuals intended to be driven to San Francisco de Macorís. And those were led like prisoners”.

Here it is important to highlight the part of the preceding two paragraphs cited by quotes which were extracted from Dessalines own war diary, that is as clear as any confession, it can be recognized as in law, according to some lawyers.

It should be noted that the invading army of Dessalines was composed of more than twenty thousand soldiers, very well endowed with the best weapons of the time of war in Europe, which the Haitians had captured from the army of Napoleón Bonaparte in the defeated of Saint-Domingue, i.e. Haiti. As it has been seen, those more than twenty thousand men received the orders, in their retreat, they dragged all the Dominican people towards Haiti as prisoners, “and the rest of them”, anyone who remain alive, the men who were prisoners were beheaded.

Only in Santiago they “dragged” 249 women, 430 girls and 318 boys, as revealed by Alejandro Llenas, and in La Vega 900 Veganos, it can be deduce that the rest of the communities where the army passed through were also in the thousands, mainly women, boys and girls. What was the fate of 249 women, the 430 girls and the 318 boys of Santiago? What happened to the 900 Veganos who were swept away, what to expected of them in Haiti? The orders of Dessalines were for those and of the thousands to be; “reduce them to prisoners, so your first order is to make them stomp like mules and other animals, when they reach the Haitian part”. It wasn’t just the 900 Veganos that were dragged, in reality it were also women and children, and those of Santiago?

Unfortunately there is not documentary evidence of this genocide in the southern region of the country, which it was where he retreated with part of his great army of Dessalines. There are only mentions in sometext written by Gaspar de Arredondo and Pichardo of the horror that the fugitives narrated coming back by roads and mountains to the Cibao area and from the South.

The second

There is a second consideration that I express here. Some historians have the belief that the invasion of Dessalines was in response to a feverish decree of war, the French general Lois Ferrand who was at that time Governor of the colony of Santo Domingo. In his article ‘Invasion of Dessalines’ Alejandro cited very well this Decree of Ferrand, which was in response to a proclamation of Dessalines calling residents of the Spanish part of the island to surrender. But in his unusual Decree of January 6, 1805 Ferrand authorizes the inhabitants and authorities of the Spanish part, to capture anyone in the territory of the Republic of Haiti up to 14 years of age, in order to sell them as slaves.

Evidently the motor of the immediate invasion of Dessalines was not this Decree, but its content that caused indignation of the Haitian authorities because that text message amounted to a proposal to re-establish slavery, which had been evidently overcome with the proclamation of independence on the part of the Haitian people, and which had also been suppressed by the French Revolution years earlier. The slaughter of 40 children on the altar of the Church of Moca and dragging them as prisoners to Haiti these 748 children of Santiago had to be a clear message. As we have said, the data is well documented, but it should not be considered a unique case. In other Dominican communities where the other butcher walked through, Henri Christophe carried out massive beheadings of children.

With those Dessalines and his official subordinates while in their forced retreat were leaving a message to Lois Ferrand. That Ferrand was not just another invader, but was short-term in the territory, and that the footprint of the genocide would produce amongst Dominicans the horror that to this day the Haitians people provoke, the anti-haitianism that “The Beheadings of Moca” (“El Degüello de Moca”) has sowed amongst Dominicans.
