Despite the court order, the access to El Encuentro beach in Cabarete is still closed
PUERTO PLATA .- A private company has violated the order of a court in this jurisdiction, which ruled to reopen the passage of El Encuentro beach, after closing the access for the bathers to the famous beach in Cabarete with the intention of privatizing it.
It is recalled that Judge Adriana Vásquez Jiménez, of the Second Civil Chamber of the Judicial District of Puerto Plata, filed an action for amparo action filed by lawyers, representatives of the Cabarete Water Sports Association and ordered the defendant to respect the free transit to public domain spaces.
The aforementioned court also condemned the defendant: Inversiones Calpe, represented by Sigurd Sandvik and the commercial company Mesa Investment Limited CXA, to the payment of an astreinte in the amount of 50 thousand pesos for each day of delay in compliance with this decision.
According to local opinions about this situation, it is ensured that there is an undeniable state weakness, since despite the decision of the court, the authorities of the Ministry of Tourism came to the place accompanied by several agents of CESTUR, and mechanically shoveled to open the road, but barely removed a fence and several stones, leaving obstacles in the middle of the road.
Last Monday, Judge Nassim Eduardo Ovalle, of the Civil Chamber of Puerto Plata, made a descent on the beach of El Encuentro in Cabarete, thus verifying the closure of the old road, which communicated to the communities of Gaspar Hernández and Sosúa.
Several sectors of Cabarete have repeatedly denounced that the beach has closed its access to visitors, with the help of some authorities in conspiracy with the named Lance Lundberg and Jesus Perdomo, who after the hearing, placed a fence to close the 60 meters from the sea.
In this regard, the president of the Association of Tourism and Environmental Protection of Cabarete and Sosúa (ASOPROCASO); Michel Gay Crosier, considered the actions of those who want to privatize the beach is a mockery of the authorities and the community.
Gay Crosier said that on the part of the provincial director of the Environment of Puerto Plata, Danilo Morrobel and other employees of that government dependence, a total disinterest is seen to act against the invaders who pretend to take possession of an inalienable public space.
