More than 35% of Dominican children do not have farther’s name in birth certificate
The Senate runs the project of responsible parenthood, authored by the former prosecutor Jose Manuel Hernandez Peguero. The project seeks to guarantee the constitutional right of children to be identified by their parents on the birth certificates, and not only by mothers.
In the Dominican Republic, out of 100 children – 88 are children of single parent, and 35% of them lacks the father’s name.
Hernandez Peguero is proposing the bill to solve this problem.
“You know that at birth, if a couple is not married, the mother’s registration is done, but for the paternal part a father’s presence is needed,” says a fellow judge of the Superior Electoral Tribunal.
He explains that the country “has a difficult procedure, and what I would do is adopt a law that exists in other countries in Latin America, as in the case of Mexico, Uruguay or Paraguay…”
Parental registration would be mandatory with this law
If this law is approved, parental registration shall be binding. As soon as the baby is born, the mother is obliged to inform who is the father, “the first right of the child is to know who your daddy is’.
“In our case, what we propose is an investigation that will be conducted by magistrate reg. the mother’s places of residence. The parent is required by the judge, and if the judge does not accept the information given by the mother, a DNA test is done ” – says Hernández Peguero.
The main objective of the law enforcement parental obligation
The purpose of this law is the fulfillment of parental obligations and that it begins with the registration of the parents, thereby shedding responsibility for maintenance, custody, clothing and education.
It is optional to register both parents, and the parent does not agree, a court process may begin.
“Dominican women has been very hurt by all authorities in all areas. Discrimination is becoming more apparent and so it is impossible for us to move towards the rule of law “.
Hernandez regrets that now the registry is an instance of financial contribution to the Central Electoral Board, and he proposes this to be free.
