Justice Department requests prison for Felix Bautista and fellow defendants
SANTO DOMINGO. The Justice Department (MP) requested yesterday preventive custody as a coercive measure against Senator Felix Bautista and the group accused of corruption and money laundering detrimental to the Dominican state. The request is part of the conclusions that the Attorney General presented to the judge of Special Instruction of the Supreme Court of Justice (SCJ), Alejandro Moscoso Segarra, who they asked, in addition, for a decree to open a trial against the accused. Besides Bautista, the request includes the defendants Soraida Antonia Abreu Martinez, José Elias Hernandez Garcia, Bolivar Antonio Ventura Rodriguez, Carlos Manuel Ozoria Martinez, Gricel Aracelis Soler Pimentel, and Bienvenido Apolinar Breton Medina.
The representatives of the MP supported the request based on the fact that with all the wealth that the group has, which includes some 500 assets, there exists a real flight risk.
“The seriousness of the accusations which have been made against the defendants, against whom it has been proven that they moved RD$25 billion, possess 175 properties in luxurious high-rise apartments that exist in the Dominican Republic, apartments, building lots at Metro Country Club, airplanes, four asphalt plants, one of which is valued at US$33 million… As a result we are dealing with a very serious incident.”
With their request, the MP concluded their presentation of evidence which supports their accusations, and now it is the turn of the defense to present their objections.
The Justice Department has among its evidence, the testimony of 15 persons, among which that of businessman Abraham Jorge Hazoury Toral, relating to the purchase of the company “Hormigones del Caribe”, stands out. With the statement of the businessman the Attorney General intends to prove that Bautista acquired this company through Ozoria, in what they define as a “clear case of injecting into the formal economy money of illicit origin.”
Laura Guerrero Pelletier, the director of the Special Prosecutor for the Persecution of Administrative Corruption (Pepca), assured reporters that the evidence that supports the accusations has been authenticated so that they are sure it will pass the preliminary phase.
The Power Point
After the MP presented its accusations and it was the turn of the defense of the Senator and other defendants, the defense lawyers requested that the judge order the Attorney General to give them the CD with the technological material of their declarations. They alleged that the Attorney General was violating the right to equal treatment. The request was objected to by the MP that said they had worked hard in doing their job and that the presentation was no different from the printed files that they had notified to the parties. They insisted that they had only organized them in a Power Point presentation and even said that the defense lawyers should not act like bad students and they should also do their homework. The judge rejected the request.
