Young woman who gave alcohol to baby is freed
SANTIAGO. A collegiate tribunal of the Penal Chamber of the Court of Appeals of the judicial district of Santiago ordered the release on Wednesday of the young mother of a minor to whom she had given beer, and whose photograph was on the social networks several weeks ago.
With this order, the judges of the Penal Chamber of the Court of Appeals dismissed the coercive measure of 3 months of preventive custody against Estephany Estevez, 18, which had been imposed by Judge Martha Martinez, after finding that the young woman had violated various articles of Law 294 – 97.
Mayobanex Martinez, who headed the group of jurists which requested the review of the coercive measure, stated that the judges of the tribunal understood and reasoned that the judge of the 4th Court of Instruction was very severe and, in addition, she had committed an injustice against the young mother.
He said that the law office of his brother, the President of the Chamber of Deputies, Abel Martinez, will continue assisting the family of Ms. Estevez, since they are humble and poor, although he did not specify with which measures they would support this family.
The Penal Chamber of the Court of Appeals also decided that the young woman who was given her freedom, should present herself periodically in the office of Psychological Assistance and Conduct of the Justice Department, which functions in the Gender Unit in Santiago.
