Family Code will allow the husband to have the name of the wife
SD. The legislative proposal for the Family Code, delivered yesterday to President Danilo Medina, would establish the option that the husband, by previous agreement, could take on the first last name of his wife either with or without the “de”.
According to a press release sent by the Vice-President of the Republic, the rough draft of the law indicates that equal rights will be had by the woman to assume or not the last name of her husband. Both the bride and groom can keep their single last names once they are married.
The document points out that this Code “proposes to promote responsible paternity” by permitting the single mothers to register their children with the last name of the person they identify as the father, “who should be notified previous to the registration of the birth” in order to then begin the process of identification, if it were necessary, of the real father of the child.
“From birth the child will have a father, although it might be presumed,” the note points out.
the legislative proposal, which seeks to unify the legislation in the matter of families contained in the Civil Code and complementary laws, also suggests equality in the administration of the assets between husband and wife.
The first draft was delivered yesterday to the President by the Vice President of the Republic, Margarity Cedeño de Fernandez, at the Presidential Palace.
